Terms of service
The agreement between JOYTECH LIMITED and a business using StaffOPs.
Draft — not yet in force
These terms are being reviewed by our lawyer. They are published here so you can see the shape of the agreement early. Nobody has been asked to agree to them, and the final version will replace this page before anyone is.
1. Who this is between
StaffOPs is provided by JOYTECH LIMITED, a New Zealand company. “You” is the business that holds the account — not the individual staff members it rosters.
2. The account
To be drafted — Who may open an account, the company account holder's role, and the responsibility for who is invited into it.
3. Your data is yours
Everything you put into StaffOPs — your people, rosters, timesheets and pay rates — remains yours. We process it to run the service for you and for nothing else. How that works in detail is in the data processing agreement.
4. What you can expect from us
To be drafted — Availability, support, notice of changes, and what happens when something goes wrong.
5. What we expect from you
To be drafted — Acceptable use, keeping account access secure, and the accuracy of what you configure — including pay rules.
6. Pay rules and wage calculations
This clause will say plainly what the product already says: StaffOPs applies the pay rules you configure. It does not interpret an award, a collective agreement or an employment agreement, and it does not advise you on what you owe someone. Checking that your configured rules match your legal obligations is your responsibility, and getting it wrong is not something software can catch for you.
To be drafted — The final wording of the limitation that follows from the above.
7. Fees
To be drafted — Price, billing period, who counts as a billable staff member, trial terms, and what happens when a subscription lapses — read-only access rather than a lock-out, because timesheets are wage records you are required to keep.
8. Ending the agreement
To be drafted — Notice, export of your data, and the deletion timetable that follows.
9. Liability
To be drafted — Under review. This is the clause most worth a lawyer's time.
10. Law
New Zealand law, New Zealand courts.
Using StaffOPs today? Your account will ask you to accept the final terms once they are in force, and you will be told before that happens.
